These Terms and Conditions ("Terms") govern your use of the website at marioninsulation.com and your engagement with the services provided by Marion Insulation ("we," "us," or "our"). By accessing our website or requesting our services, you agree to be bound by these Terms. Please read them carefully.
By using our website, submitting a contact form, or engaging us for any service, you confirm that you are at least 18 years of age, have the legal authority to enter into an agreement, and agree to these Terms. If you do not agree, please do not use our website or request our services.
Marion Insulation provides residential and commercial insulation services including, but not limited to, spray foam insulation, attic insulation, blown-in insulation, crawl space insulation, basement insulation, wall insulation, air sealing, vapor barrier installation, and related insulation services in Marion, IL and surrounding communities.
All services are subject to a written estimate and signed agreement prior to work commencing. We reserve the right to decline any project at our sole discretion.
All estimates are provided in writing following an on-site assessment. Estimates are valid for 30 days from the date of issuance unless otherwise stated. Verbal estimates are not binding.
Final pricing may differ from the estimate if conditions discovered during the work - such as hidden moisture damage, structural issues, or additional scope not visible during the estimate visit - require changes to the original plan. We will notify you before proceeding with any work that falls outside the original written estimate.
We are not responsible for cost increases resulting from changes you request after work has begun, or from conditions that were concealed and not reasonably discoverable during the estimate visit.
Scheduling is confirmed once a written estimate is accepted and any required deposit is received. We will make every reasonable effort to honor the scheduled date, but we reserve the right to reschedule due to weather, material availability, or other circumstances beyond our control.
If you need to cancel or reschedule, please notify us at least 48 hours in advance. Cancellations made less than 48 hours before the scheduled start time may result in a fee to cover mobilization costs, as specified in your written agreement.
If we cancel a scheduled appointment, we will contact you promptly and work with you to reschedule at a mutually convenient time. No cancellation fee will be charged to you in that case.
Payment terms are specified in your written estimate and project agreement. In general, a deposit may be required prior to scheduling, with the balance due upon completion of the work unless otherwise agreed in writing.
Accepted payment methods will be specified in your agreement. Late payments may be subject to a finance charge as permitted by Illinois law. We reserve the right to suspend or withhold warranty coverage for accounts with outstanding balances.
If payment is not received within the timeframe specified in your agreement, we reserve the right to pursue collection through any legal means available, including the filing of a mechanics lien against the property where permitted by Illinois law.
We stand behind our workmanship. Any workmanship warranty applicable to your project will be specified in your written agreement.
Product warranties are provided by the manufacturer and are separate from our workmanship warranty. We will make reasonable efforts to assist you in pursuing a manufacturer warranty claim, but we are not responsible for manufacturer decisions or timelines.
Warranties do not cover damage resulting from events outside our control, including but not limited to flooding, fire, structural movement, improper modifications by others, or failure of adjacent building systems not part of our scope of work.
To the fullest extent permitted by applicable law, Marion Insulation shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the services we provide or your use of our website, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from a specific project shall not exceed the total amount paid by you for that project. Nothing in these Terms limits our liability for personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
The content on our website is provided for general informational purposes only. We make no representations or warranties about the accuracy or completeness of any information on the site.
You may not use our website to engage in any unlawful activity, transmit spam or malicious content, or attempt to gain unauthorized access to our systems. We reserve the right to block access to users who violate these conditions.
If a dispute arises between you and Marion Insulation in connection with our services or these Terms, both parties agree to attempt to resolve the matter informally first by contacting us directly at team@marioninsulation.com.
If informal resolution is not successful within 30 days, both parties agree to submit the dispute to binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. Class action arbitration is not permitted.
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes not subject to arbitration shall be resolved in the state or federal courts located in Williamson County, Illinois.
We reserve the right to update these Terms at any time. When we do, we will update the effective date at the top of this page. Changes take effect immediately upon posting. Continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms.
